Terms of service

1. Acceptance
By creating an account or using Pulsus (the “Service”) you accept these Terms of Service (“Terms”). If you don't accept them, don't use the Service.
2. Age + eligibility
You must be at least 16 years old to use Pulsus. See the children's privacy notice for why.
3. Wellness tool, not medical device
Pulsus is a general wellness product. It does not diagnose, treat, cure, or prevent any condition. Before using it please read the medical disclaimer.
4. Assumption of risk
You acknowledge that Pulsus is a wellness tool and that you are solely responsible for any decision to start, stop or change a medical, dietary, fitness, or lifestyle practice on the basis of the app's output. You agree to consult a licensed clinician for medical questions and not to rely on the Service in any medical emergency.
5. Account + security
Keep your credentials secret. You're responsible for any activity under your account. Notify us promptly if you suspect a compromise at security@pulsus.co.
6. Subscription + billing
Paid plans auto-renew at the end of each billing period unless cancelled. You can cancel any time from Settings → Billing. A 7-day free trial applies to first-time Plus and Pro subscribers; the card on file is charged at the end of the trial unless cancelled.
7. 30-day money-back guarantee
For new subscriptions we offer a 30-day money-back guarantee. Request a refund from support@pulsus.co within 30 days of your first paid charge — no questions asked. App-store-mediated subscriptions (if ever enabled) follow the refund rules of the relevant store.
8. Acceptable use
The full rules are in our Acceptable Use Policy. Breaching them lets us suspend or terminate your access.
9. Intellectual property
Pulsus's code, brand, and content are ours or licensed to us. You keep ownership of everything you submit (chat messages, notes, shared measurements). You grant us a worldwide, royalty-free licence to host, store, transmit, display and adapt your submissions strictly for the purpose of running the Service for you. We do not use your submissions to train any public large-language model; see the AI coach policy.
10. Third-party services
Pulsus relies on third-party processors (see our subprocessor list). We're responsible for how we deploy them; their own terms govern anything you interact with on their surfaces.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR- FREE, OR THAT THE METRICS WE COMPUTE WILL MATCH CLINICAL- GRADE MEASUREMENTS. Some jurisdictions do not allow the exclusion of implied warranties; in those places these exclusions may not apply to you in full.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) US$100. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
Consumer-statute carve-outs. Nothing in this section limits liability we cannot lawfully limit, including liability for fraud, wilful misconduct, personal injury or death caused by our negligence, or any other liability that applicable law prohibits excluding. Consumers in the EU, UK, Turkey and Australia retain their statutory rights in full regardless of the cap above.
13. Indemnification
You agree to defend, indemnify and hold Pulsus Labs, its directors, employees and agents harmless from any claim or demand made by a third party arising out of (a) content you submit to the Service, (b) your use of the Service in violation of these Terms or applicable law, or (c) your infringement of a third party's rights. We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and you'll cooperate with our defence.
14. Dispute resolution — United States
This section applies only to US-resident users. Except for small-claims matters and requests for injunctive relief to stop IP or confidentiality violations, you and Pulsus Labs agree to resolve all disputes by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in New Castle County, Delaware. You waive the right to a jury trial and to participate in a class action, class arbitration or consolidated proceeding.
Opt-out. You may opt out of this arbitration agreement by sending written notice to legal@pulsus.co within 30 days of first accepting these Terms. Opting out has no effect on any other part of these Terms.
15. Dispute resolution — EU, UK, Turkey, Australia, rest of world
If you live in the EU, UK, Turkey, Australia or any other jurisdiction whose law prohibits pre-dispute binding arbitration with consumers, Section 14 does not apply to you. You keep every right to bring a claim before a competent court in your place of residence, and mandatory consumer protection laws of that country apply regardless of what these Terms say.
16. Governing law
Delaware law, without regard to conflict-of-laws principles, governs these Terms and any non-arbitrable dispute brought by a US resident. For EU, UK, Turkey and Australian consumers, the mandatory law of your country of residence applies. Turkish consumers: İstanbul Merkez mahkeme ve icra daireleri yetkili kılınmıştır, ancak KVKK ve 6502 sayılı Tüketicinin Korunması Hakkında Kanun çerçevesindeki hakları saklıdır.
17. Termination
We may suspend or terminate your access immediately if you violate these Terms or the AUP. You may terminate at any time by cancelling your subscription and deleting your account at /legal/delete-account. Sections on intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution and governing law survive termination.
18. Export controls
You confirm that you are not on a US government denied-parties list, not located in a jurisdiction under comprehensive US sanctions (currently including Cuba, Iran, North Korea, Syria, Crimea, Donetsk, Luhansk, Zaporizhia and Kherson), and that you won't use the Service for any purpose prohibited by US export laws or Turkish sanctions regulations.
19. Changes to these terms
We may update these Terms. Material changes receive at least 30 days' advance notice to EU and UK users and reasonable notice elsewhere; every change is recorded in the version history. Continued use after the effective date constitutes acceptance of the updated Terms.
